The plaintiff has appealed from the order of the district court
sustaining his motion for summary judgment in an amount less than
the amount he sought to recover in an action commenced pursuant
to K.S.A. 44-512a. On or about November 15, 1962, the claimant sustained personal
injury by accident which arose out of and in the course of his
employment. He timely commenced a proceeding before the workmen's
compensation director, and his claim, like Rip VanWinkle, lay
peacefully sleeping in the office of the director until July 12,
1966, when a hearing was had before an examiner. Again the
